By using our Services, you confirm you meet this requirement.
3. Estimates, Proposals & Project Agreements
Any estimate, proposal, or project scope provided by Capital Development:
Is based on information available at the time
May change if project conditions, materials, or client needs change
Becomes binding only when both parties sign a formal contract
You are responsible for providing accurate information regarding property conditions, access, materials, and project expectations.
4. Payments & Billing
Payments may be collected through:
Secure online processors (e.g., Stripe)
Bank transfer
Check
Other approved methods
Billing Terms
Payment schedules will be outlined in your project contract
Deposits or retainers may be required to begin work
Late payments may incur fees as outlined in the agreement
Payments already made are generally non-refundable unless required by applicable law
You are responsible for ensuring your payment method remains active and accurate
5. Project Changes & Delays
You acknowledge that construction timelines can be affected by:
Weather
Material availability
Permits or inspections
Third-party delays
Structural or unforeseen conditions
Client-requested modifications
Change orders may result in additional costs or revised timelines.
All change orders must be approved in writing.
6. Communications Consent
By contacting Capital Development or initiating a project, you consent to receive:
Project updates
Scheduling notifications
Estimates and invoices
Important service alerts
Optional marketing or promotional messages
You may opt out of promotional communications at any time by clicking “Unsubscribe” in emails or replying “STOP” to SMS.
Service-related messages may still be delivered when required for your project.
7. Acceptable Use of Website & Digital Tools
You agree not to:
Use our website or forms for unlawful purposes
Submit false, misleading, or inaccurate information
Attempt to bypass security or access unauthorized areas
Upload harmful content, malware, or unauthorized files
8. Intellectual Property

10. Limitation of Liability
To the fullest extent permitted by law:
Capital Development is not liable for indirect, incidental, special, or consequential damages
Our total liability is limited to the amount paid for the specific services or portion of the project in question
We are not responsible for delays caused by third parties, government entities, suppliers, or unforeseeable conditions
These limitations apply even if we have been advised of potential damages.
11. Termination of Services
We may suspend or terminate Services if:
Payments are not made on time
Project information is misrepresented
Property access is repeatedly restricted
Terms or contracts are violated
You may request termination based on your project agreement, though cancellation fees or payment obligations may still apply.
12. Dispute Resolution
Mediation
If a dispute arises, both parties agree to attempt resolution through good-faith mediation in the State of Georgia.
Arbitration
If mediation does not resolve the issue, disputes shall be settled through binding arbitration in Georgia under the American Arbitration Association (AAA) rules.
Finality
Arbitration is final and binding.
Judgment may be entered into any court with competent jurisdiction.
13. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles.
